General Terms and Conditions (GTC) of einBastien

1. Scope
   These General Terms and Conditions apply to all purchases made by private customers from einBastien, trading under the name einBastien. Private customers are individuals residing in and receiving deliveries within Europe, whose orders cannot be attributed to any commercial or self-employed professional activity.

2. Conclusion of Contract
   The presentation of our products and the opportunity to order constitute a binding offer to conclude a purchase contract. By placing your order, you accept this offer. The contract is concluded when we confirm the order by email to the address you provided.

3. Prices and Shipping Costs
   All prices listed are final prices and include VAT. Additional shipping costs apply, which depend on the shipping method, size, and weight of the goods. We cover the costs of any return shipment within the scope of the right of withdrawal.

4. Payment Terms
   Payment for goods can be made via: Amazon Pay, Apple Pay, Google Pay, credit card, direct debit, prepayment, Giropay, Paydirekt, PayPal, Klarna. In case of late payment, we are entitled to charge interest on arrears at a rate of 5 percentage points above the base interest rate per annum.

5. Delivery
   Delivery will be made within 7 days to the address specified by the customer, provided the goods are in stock. In cases of force majeure or unreasonable effort, we may be released from our obligation to perform.

6. Print-on-Demand and Digital Products
   einBastien operates on a print-on-demand basis. This means all products are made to order and tailored to your specifications when you place your order. Therefore, we do not offer a right of withdrawal or general returns.
   Premium tickets and bonus items: Please note that premium tickets and the associated textile or bonus products, which are produced specifically for your order, are excluded from exchange. An exchange is only possible if a product is delivered with defects or damage.
   There is no right of withdrawal for digital song downloads once the download has been completed or access has been granted.

7. Returns
   Please use the fully prepaid and pre-addressed return label included with the shipment for any returns. This is the simplest and most cost-effective return option. If you choose a more expensive shipping method, the additional costs may be charged to you.

8. Retention of Title
   The goods remain our property until full payment has been made.

9. Warranty and Defects
   Statutory warranty rights apply. In the event of defects, the customer may request a remedy. If the chosen remedy is unreasonable, we may opt for an alternative remedy.

10. Liability
    We are only liable for slight negligence in the event of a breach of essential contractual obligations, and our liability is limited to foreseeable damages. The personal liability of our legal representatives, agents, and employees for damages caused by slight negligence is excluded.

11. Applicable Law and Jurisdiction
    German law exclusively applies. The place of jurisdiction is Dortmund, provided the customer does not have a residence in Germany.

12. Alternative Dispute Resolution
    The EU Commission provides a platform for online dispute resolution: http://ec.europa.eu/consumers/odr.
    We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
